Agreement to Terms

By accessing or using gordonrush.com (the "Site"), you agree to be bound by these Terms of Service. If you do not agree, you may not access the Site. These Terms apply to all visitors, users, and customers.

Products & Orders

All product descriptions, images, pricing, and availability are subject to change without notice. We reserve the right to limit quantities, refuse orders, and correct pricing errors. Colors displayed on screen may not exactly match the physical product due to monitor variations.

Intellectual Property

All content on the Site — including the Gordon Rush name, logo, product designs, photography, copy, and trademarks — is the exclusive property of Gordon Rush or its licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Limitation of Liability

To the fullest extent permitted by applicable law, Gordon Rush shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any products purchased through it. Our total liability shall not exceed the amount you paid for the specific product giving rise to the claim.

Dispute Resolution & Arbitration

Any dispute arising from these Terms or your use of the Site shall be resolved through binding arbitration administered by JAMS in San Diego County, California, rather than in court. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration. Either party may seek injunctive relief in a court of competent jurisdiction.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings shall be conducted in the state or federal courts located in San Diego County, California.
